For your accident, old debt (even those you’re not responsible for) becomes a very profitable activity. Companies can buy this debt for very little money (sometimes referred to as “debt debt”) and then look for people who are likely to afford it. A call can be a harassment, harassment, demand threat and other inappropriate (and sometimes illegal) actions. If you ever run a debt collector who asks you to pay a “returned” debt, you will have to do what is needed to defend your rights.
Deny the debt
If you are not quite sure that you have that debt, don’t say something that might suggest that this debt is your own. Don’t accept any type of payment. If you do, the company may have the legal right to collect that debt, which would not happen if you never acknowledged it.
Keep your integrity and your moral, but don’t let them manipulate you to make a strategic mistake. The business of “junk credits” (and in general, the financial system) revolves around profits and does not regard integrity or morality. In fact, if you pay the debt, negative comments will appear on your credit reports! This is a mistake in the credit register system. The collectors know this, your goal is to damage your ABC score with a few bucks, they don’t mind. It would be better to hang the phone to the collector and donate that money to a church or charity.
Know your rights, protected under the law of fair debt collection
Keep in mind that it is not allowed to be harassed by the collection agencies, to call you too early or to call you or to keep you in touch after expressing your wish to stop it (except for the intention to: search for an exit legally or say they will stop contacting you).
If you are responsible for the debt, if you have not yet prescribed it, it is negotiated with caution.
Never give your bank information to a collection agency. If the agency has that information, you can withdraw the amount of the debt directly from your bank account and you can’t do anything to avoid it.
Do not ignore a summons before the courts , even if you believe the debt has been prescribed. Hire a lawyer. If you do not appear at the trial, it is likely that the judge will accept all the charges against you and the collection agency will give whatever they ask for. It is called non-appearance or “judgment in absence” and can be executed regardless of the legitimacy of the debt.
If you make a payment, even a small “good faith” payment, the prescription period can be extended or a new collection process can begin if the debt has expired.
Consult a lawyer when in doubt or if you are not sure about the laws related to that debt
This is not a big problem if you reach an agreement for an amount less than the total. The remaining balance is reported to the tax office. You will pay a tax on profits equal to this amount unless you can prove your insolvency.
